Court grants Apple's reject for preliminary injunction against Galaxy Nexus

To follow up on the preliminary injunction banning sales of the Galaxy Tab 10.1 in the U.S., the same judge also has ordered a ban on Galaxy Nexus sales. As Engadget points out, the dispute centers on Android 4.0 (Ice Cream Sandwich)'s slide-to-unlock mechanism and other issues.

The Galaxy Nexus went on sale in the U.S. on December 15 and is currently Android's flagship device for promoting Ice Cream Sandwich and its successor, Android 4.1 Jelly Bean.

HBT: Twins living in past with Doumit extension

This two-year, $7 million contract extension is a signing from 2002.

Ryan Doumit is exactly the kind of player a smart team would go year to year with. He is?

a) over 30
b) injury prone
c) below average defensively wherever he plays

Doumit?s career highs are 124 games, 431 at-bats, 15 homers and 69 RBI. He had his best season four years ago when he was 27. He was also very good last season, but it was in 218 at-bats. This year, he?s also been quite good so far, though we?re still talking about a .775 OPS. He had a .718 OPS eight days ago.

I like Doumit. His body wasn?t made to withstand the rigors of catching regularly, but the Twins seem to have carved out a great niche for him this year; he?s on pace to catch 60 games and DH in about 50 more. There?s a fair enough chance he?ll stay relatively healthy and maintain something close to that .775 OPS the rest of the way, and in Target Field, that makes him a fair asset.

But that?s 2012. He?s only going to be a worse bet going forward. The Twins were able to sign him to a one-year, $3 million contract as a free agent over the winter, and nothing that?s happened since has made him a better bet for age-32 and -33 seasons.

Ignoring for a moment the fact that the Twins seem to be working to keep together their probable 95-loss team, smart clubs don?t give out multiyear deals unless there?s real upside to them. Given his lack of a position, Doumit would have had to go on a serious tear for anyone to ante up even a two-year, $10 million offer to him this winter, and little in his history suggests it was likely to happen. Doumit suffering a serious injury that would have negatively affected his value headed into 2013 is a ?much more likely scenario.

This is just one of those completely unnecessary multiyear deals we don?t see quite as often these days as we used to. Obviously, it?s not going to bankrupt the franchise if it doesn?t work out, but there also isn?t much to be gained. The Twins could have waited until the winter and made sure they still wanted him back.

Mergers: Commission approves acquisition of IBM's retail store solutions business by rival Toshiba

The European Commission has cleared under the EU Merger Regulation the proposed acquisition of IBM's retail store solutions business by Toshiba Tec, a majority owned subsidiary of the Japanese company Toshiba. Retail solutions are integrated systems of hardware and software that are used for processing sales transactions by retail store customers. They are capable of connecting and interoperating with a retailer?s other IT and software systems and are therefore distinguished from electronic cash registers. The Commission concluded that the transaction will not raise competition concerns because of the limited overlap between the parties' activities, in particular within the European Economic Area (EEA), and because the merged entity will face sufficient competition.

The proposed transaction would lead to an overlap between the parties' activities in the market for retail solutions, which includes point-of-sale (?POS?) systems, PC-on-cash-drawer (?PCCD") systems and self-service-systems. The Commission investigated the transaction's competitive effects on this overall product market as well as its possible sub-markets segmented by type of retail solutions (such as POS, PCCD, etc.) or customer segments (such as food retailers, convenience stores and petroleum outlets etc.).

The Commission's investigation found that the merged entity will continue to face substantial competition from several well-established, strong and effective competitors in the market(s) concerned. In addition, the investigation revealed that the parties were not each other's' closest competitors and that customers can easily switch suppliers.

The Commission therefore concluded that the transaction does not raise serious doubts as to its compatibility with the internal market and with the EEA Agreement.

The operation was notified to the Commission on 24 May 2012.

Companies and products

Toshiba is a diversified manufacturer, providing a wide range of products and services on a global basis in four business domains: digital products, electronic devices, social infrastructure and home appliances. Toshiba Tec falls within Toshiba?s digital products business domain and manufactures products and business solutions in four core areas: (i) retail solutions, (ii) office solutions, (iii) supply chain solutions and (iv) inkjet heads.

IBM is a U.S. public company active worldwide in the development, production, and marketing of a wide variety of information technology solutions. IBM's retail store solutions business is active within IBM's system and technology business segment and comprises the development and distribution of retail solutions, including POS systems, self-service-systems, and related maintenance and technical support services.

Merger control rules and procedures

The Commission has the duty to assess mergers and acquisitions involving companies with a turnover above certain thresholds (see Article 1 of the Merger Regulation) and to prevent concentrations that would significantly impede effective competition in the European Economic Area (EEA) or any substantial part of it.

The vast majority of mergers do not pose competition problems and are cleared after a routine review. From the moment a transaction is notified, the Commission generally has a total of 25 working days to decide whether to grant approval (Phase I) or to start an in-depth investigation (Phase II).

NBC's Lauer Invites David Axelrod to Slam GOP Over Holder Contempt Vote

On Friday's NBC Today co-host Matt Lauer didn't just lob a softball to Obama campaign advisor David Axelrod about Attorney General Eric Holder being held in contempt of Congress, he placed the ball on a tee and helped Axelrod swing the bat: "Paraphrasing here, Mr. Holder said the American people deserve better. What is the President's reaction to the actions in Congress?"

Axelrod happily spewed White House talking points on the Thursday vote that held Holder in contempt for failing to release documents regarding the Fast and Furious gun-walking scandal: "I think it was an embarrassment to the Congress....They're getting their questions answered, they wanted the confrontation, they wanted the political theater. They ought to be getting to work on the problems that are significant to the American people."

Prior to Lauer's interview with Axelrod, correspondent Kelly O'Donnell began a report on the development by highlighting a Democratic stunt that occurred during the contempt vote: "Without enough votes to defend the Attorney General, Democrats used their feet to send a message to Republicans. They marched out of the Capitol....And straight to the cameras." A clip was played of the liberal congressional members chanting "Shame on you!" on the steps of the Capitol.

O'Donnell did note that 17 Democrats voted for contempt and included Republican sound bites in the piece. However, she wrapped up the report by noting: "Holder lashed out at House Republicans, calling contempt a political stunt." A clip of Holder followed: "It is at base, both a crass effort and a grave disservice to the American people. They expect and they deserve far more."

In an 8 a.m. brief, news reader Natalie Morales made sure to include: "Holder has dismissed the vote as politically motivated."

Lauer actually grilled Axelrod about the Supreme Court upholding ObamaCare with this tough series of questions:

So does the President win a victory in the Supreme Court and then take a beating for it in the voting booth in November?

If only NBC offered a Republican guest a chance to respond to the ruling.

LAUER: David Axelrod is a senior adviser to President Obama's re-election campaign. David, good to have you here.

DAVID AXELROD: Good to be here, Matt. Thank you.

LAUER: Nice to you. Let's talk about this. Anybody who thought that the Supreme Court's decision on health care was going to end the debate was delusional. The Republicans have now scheduled a vote on July 11th in the House to repeal the law. Is this a fight that the White House is going to engage in?

[ON-SCREEN HEADLINE: Supreme Victory?; Obama Campaign on Impact of Health Care Ruling]

AXELROD: Well, I think that the Court spoke, we're going to move forward on implementation. As [correspondent] Kelly [O'Donnell] suggested, I don't think there's an expectation that the law is going to be overturned in Congress. The Republicans think they can make a political issue of this. But they're going to have to explain why they want to roll back a law that's already producing so much good for the American people. You know, kids who are 26 and under, who are on their parents insurance. Senior citizens who are getting help with their prescription drugs. Folks who don't have lifetime caps on their insurance anymore.

LAUER: Isn't there good-

AXELROD: There's so much that's already working, why do they want to roll it back?

LAUER: The good news is the Supreme Court said that the mandates are constitutional. The bad news is they said they are a tax. Back in 2009, the President adamantly denied that health care reform was going to be a tax on the American people. Does he now agree that this legislation, this law, is a tax?

AXELROD: Whatever you call it, Matt, whether you call it a mandate or a tax, what it is, is a penalty on the very few Americans who don't ? who can afford health care, don't pay for it, end up in our emergency rooms getting free care and then we all pay for it in the form of higher premiums. That's not fair-

LAUER: But you know whatever you call it is important. In an election year and coming out of a recession, if it's called a tax, it's gonna hurt.

AXELROD: Yeah, but what I would suggest to you is that you direct that question to Governor Romney, who was the chief proponent of this very policy when he was Governor of Massachusetts, because he said it was fair to make sure that there weren't free-riders who were driving up everybody's insurance rates. That was right then. You should ask him why he doesn't think it's right now.

LAUER: The pres ? the const ? the Supreme Court has said it's constitutional. AXELROD: Well, first of all, you're asking the wrong question. Because I don't think, at the end of the day, the question is, did the President win? Did Romney win? The question is, did the American people win? Is the middle class stronger? Are Americans stronger? Are they more secure because of their law ? this law? And the answer to that is yes. I'm the parent of a child who has a chronic illness, I think you know that. And from the time she was quite young, I was one of those Americans, 30 years ago, who almost went bankrupt because the insurance company wouldn't cover what she needed to stay alive. That's not the country that we believe in, Matt.

LAUER: Let me ask you to comment, just briefly, at the end here, David, on what Congress did yesterday, voting to hold Eric Holder in criminal and civil contempt of Congress. Paraphrasing here, Mr. Holder said the American people deserve better. What is the President's reaction to the actions in Congress?

AXELROD: Well, Kelly O'Donnell said this was an embarrassment to the administration, I think it was an embarrassment to the Congress. We've got serious problems in this country and Mr. Holder's turned over 7,000 documents, 11 times there's been testimony from th administration. They're getting their questions answered, they wanted the confrontation, they wanted the political theater. They ought to be getting to work on the problems that are significant to the American people.

The world is about to get a well-earned long weekend but don't make big plans because it will only last an extra second.

A so-called 'leap second' will be added to the world's atomic clocks as they undergo a rare adjustment to keep them in step with the slowing rotation of the earth.

To achieve the adjustment, on Saturday night atomic clocks will read 23 hours, 59 minutes and 60 seconds before moving on to midnight Greenwich Mean Time.

Super-accurate atomic clocks are the ultimate reference point by which the world sets its wrist watches.

But their precise regularity - which is much more constant than the shifting movement of the earth around the sun that marks out our days and nights - brings problems of its own.

If no adjustments were made, the clocks would move further ahead and after many years the sun would set at midday. Leap seconds perform a similar function to the extra day in each leap year which keeps the calendar in sync with the seasons.

The grandly named International Earth Rotation and Reference Systems Service (IERS) based in Paris, is responsible for keeping track of the gap between atomic and planetary time and issuing international edicts on the addition of leap seconds.

"We want to have both times close together and it's not possible to adjust the earth's rotation," Daniel Gambis, head of the Earth Orientation Centre of the IERS, told Reuters.

Gambis said the turning of the earth and its movement around the sun are far from constant.

In recent years a leap second has been added every few years, slightly more infrequent than in the 1970s despite the long-term slowdown in the earth's rotation caused by tides, earthquakes and a host of other natural phenomena.

Adjustments to atomic clocks are more than a technical curiosity.

A collection of the highly-accurate devices are used to set Coordinated Universal Time which governs time standards on the world wide web, satellite navigation, banking computer networks and international air traffic systems.

There have been calls to abandon leap seconds but a meeting of the International Telecommunications Union (ITU), the U.N. agency responsible for international communications standards, failed to reach a consensus in January.

"They decided not to decide anything," says Gambis, adding that another attempt will be made in 2015.

Opponents of the leap second want a simpler system that avoids the costs and margin for error in making manual changes to thousands of computer networks. Supporters argue it needs to stay to preserve the precision of systems in areas like navigation.

Britain's Royal Astronomical Society says the leap second should be retained until there is a much broader debate on the change.

"This is something that affects not just the telecom industry," said RAS spokesman Robert Massey. "It would decouple time-keeping from the position of the sun in the sky and so a broad debate is needed."

Time standards are important in professional astronomy for pointing telescopes in the right direction but critical systems in other areas, not least defense, would also be affected by the change.

"To argue that it would be pain free is not quite true," Massey said.

A decision is not urgent. Some estimate that if the current arrangement stays, the world may eventually have to start adding two leap seconds a year. But that is not expected to happen for another hundreds years or so.

In the meantime, Massey plans to use his extra second wisely this weekend. "I'll enjoy it with an extra second in bed," he said.

Boeing taps salesman Conner to run commercial planes

SEATTLE (Reuters) - Boeing Co appointed a new head of its commercial plane unit on Tuesday, turning to a veteran production expert and salesman to help gain the upper hand in its battle with Airbus for the $100 billion-a-year aircraft market.

The surprise move, just weeks before the Farnborough Airshow, comes as Boeing attempts to ramp up production of its civil aircraft, including the troubled 787, and regain its leading position in the key single-aisle market after losing a large American Airlines order to rival Airbus.

Boeing said Ray Conner would be the new head of its best-known unit with immediate effect, replacing another longtime Boeing executive, Jim Albaugh.

Conner, 57, joined Boeing in 1977 as a mechanic and worked his way up the company's production, supply chain and marketing operations to become head of sales. Albaugh, 62, who came to prominence at Boeing's defense unit, is to retire on October 1 -- three years before Boeing's standard retirement age -- after 37 years with the company.

The move was greeted positively by industry analysts, who applauded the appointment of a sales-oriented head in place of the engineering-minded Albaugh.

"Commercial aircraft sales is a very customer-centric job," said Carter Leake, an analyst at BB&T Capital Markets. "Conner is more from true-blue aircraft sales than Albaugh. Arguably Conner has touched more Boeing customers than any person in the entire company."

SALES JOB

One industry source said Albaugh wanted to hand over the reins now so that his successor would have a chance to represent Boeing at Farnborough, one of the most important events in the company's calendar where it will be under pressure to announce new orders.

"It's a good time to step aside and open the door to increased effort on sales where Conner has most recently focused his attention," said Stifel Nicolaus analyst Stephen Levenson.

Conner was only recently appointed to his second stint in the top sales job after a shake-up prompted by Airbus marching into core Boeing territory last July and persuading American Airlines to buy 260 of its narrow-body A320s, alongside 200 Boeing 737s.

The 737 is the work-horse for most airlines and Boeing's biggest cash generator, but Boeing upset some customers by delaying a decision on what to do with its replacement, eventually deciding to follow Airbus and offer a revamped version, called the 737 MAX, instead of building an all-new airplane.

Since the launch of the MAX last August, the quiet-spoken Conner has led Boeing's rebound in the aircraft market and the company is expected to outsell Airbus this year for the first time since 2006, largely on the back of orders for the MAX.

After Farnborough, Conner must turn his attention to Boeing's audacious attempt to ramp up production of its revolutionary, carbon-fiber 787 to 10 a month by the end of next year from 3.5 a month now, as well as oversee increased production of 737s and 777s.

In a memo to Boeing employees sent on Tuesday and obtained by Reuters, Conner said he aimed to focus on delivering the planes in Boeing's bulging order book.

"Our job going forward together in the near term is to stay the course on the product and services strategies that have resulted in our record backlog, and to turn up the gain on performance and execution to ensure we meet our commitments," said Conner in the memo.

MANAGEMENT CHANGE

One analyst said Albaugh's retirement signaled a broader process of management change at Boeing.

"The generational shift in Boeing management is now almost done, with only CEO Jim McNerney left of the old guard," said Rob Stallard at RBC Capital Markets. "Who succeeds him remains to be seen, but Boeing now has two relatively new and capable executives heading each division, and each could be vying for the top slot in due course."

Dennis Muilenburg took over as head of Boeing's defense, space and security unit in 2009, when Albaugh left to take charge at the commercial airplanes unit as the company looked for a steady hand to guide the early production of the troubled 787 Dreamliner program.

With 787 production now stabilized, Albaugh's retirement is the second high-profile departure after Boeing's finance chief James Bell retired earlier this year.

Industry-watchers agree that Albaugh achieved that, while he also brought the new 747-8 jumbo to market and presided over an unprecedented labor agreement at Boeing's volatile Seattle-area plants.

Albaugh's support was key to Boeing's winning back a multibillion-dollar U.S. Air Force contract to build 179 new refueling planes that had been awarded to Northrop Grumman Corp and its European partner, Airbus parent EADS .

"Realistically, he's accomplished everything he was trying to do at Boeing Commercial Aircraft," said defense consultant Loren Thompson at the Lexington Institute.

One senior industry official said Albaugh likely wanted to exit Boeing at the "top of his game".

"He's run Boeing defense. He's run Boeing commercial, and he's not going to be CEO at Boeing."

You are at camp or on?a retreat. It is raining ? no chance for going outdoors. What do you do? Here are some more indoor-type fun games just for this ?What?ll-we-do-now?? problem. Most of the games can be adapted for all ages.

Tetherball Contact Dropout

The leader sits on the ground and swings a tetherball?over his head as he would a lariat rope close to the ground. Players join around in a circle within range of the circling tetherball. All players jump the ball and rope as it circles. If touched or knocked down by the ball, the players drop out. If a player jumps back out of the radius of the tetherball, he has fouled and must drop out. This continues until a single winner is declared. This is an excellent coed game with lots of action.

Novelty Program

Include a shoe scramble, a balloon relay, a barefoot marble-between-toes relay, a tow sack relay (get into sack up to waist, hold top, and hop), and a paper cup and water pitcher relay. For this last relay, give each person a paper cup. Have a water pitcher and a judge for each relay line. Contestants run to table with pitcher of water, pour a cupful, drink it, and return for the next person in line to repeat. A winner is declared when pitcher is empty.

Pocketbook Contest

This is a marvelous game for students and adults. It works well with a seated audience. Divide the audience into two more groups. Appoint a captain for each group. Call for items that may be?found in women?s purses of men?s billfolds. The first captain to secure from his group the items called for and race to the leader with them wins a point for his team. The leader should stand an equal distance from all of the?teams. Some items to be?called for can be?a twenty-cent stamp, a can of hair spray, a pocketknife, nail clippers, an emery board, a safety pin, a key chain with six keys, a paper clip, and an unopened package of gum.

Firing Line

Get the ?shooters? lined up into teams. Provide each team with a water pistol and a bowl of water. At a set distance (depending on the firing power of the pistols), set in pans of water a candle for each team. At a signal, the first player of each team shoots at the candle until he puts it out. While the candle is being relighted, the second player moves up and fills the pistol from the bowl. The winner is the team that shoots all the candles out first.

Chinese Balloon Carry (relay)

Each contestant must hold an inflated balloon between two eighteen-inch dowel sticks and carry it from a starting point to a finish line thirty to fifty feet away and back.

Skill Games

A whole evening social hour on a retreat may be built around skill games. Divide the group for competition and try some of these games. (Use masking tape for marking boundary lines.)

1. Tennis ball bounce?Try to bounce tennis balls in wastebasket placed on a chair fifteen feet away (ten points per basket).

2. Pie-pan roll?Using a six-foot circle marked on the floor, players stand fifteen feet away and try to roll the pans into it (ten points for each pan in the circle).

3. Jar-ring toss?From a distance of eight feet, each player throws six fruit jar rings at the neck of a plastic detergent container (twenty-five points for each ringer).

4. Muffin-tin toss?Each person throws six pennies into an ordinary muffin tin from a distance of ten feet (five points for each penny in the muffin tin).

5. Bird throw?From ten feet away, players toss six badminton shuttlecocks into a number ten can (fifteen points for each score).

6. Target toss?Players throw six washers at a six-inch circle drawn on the floor, standing fifteen feet away for each throw. (Score ten points for each washer in the circle; washers on a line do not count.)

Handball Dropout

Turn dining tables on their sides (to serve as nets). Use masking tape or chalk to mark boundary lines on the floor. A tennis ball or playground ball is the only other equipment necessary. Play regular Ping-Pong rules and hit the ball back and forth with the open hand.

Water Tunes

Divide the retreat/camp group into smaller groups of eight to ten players. Supply soft drink bottles, metal spoons, and water. Give each group fifteen to twenty minutes to fill their bottles with water and rehearse a tune. Each group then plays their tune for the others to guess the name.

Draw That Tune

Divide into two groups. Provide chalkboards or poster board and magic markers for use in drawing. Each group sends a ?drawer? to the leader. The leader gives the two ?drawers? a slip of paper with the same song title on it. The ?drawers? then rush to their own group and draw while their teammates try to guess the name of the tune. The group to name their tune first wins. Play several rounds, keeping score and using a different person to draw each time.

Use your imagination to work up unusual fun activities. Develop group spirit and be creative. A group of teenagers can take any ?germ cell? idea and make it blossom into a fun activity. Books on recreation are full of good ideas. This article is intended simply to start you thinking. Think, plan, and be ready for the unexpected, because there is nothing worse than dead moments on a retreat.

Denser development is good for single-family home values

ScienceDaily (June 26, 2012) ? How do denser neighborhoods affect property values? And what's the economic value of walkable neighborhoods?

A study conducted by researchers at the University of Washington College of Built Environments and a South Korean university shows that, contrary to popular belief, there's a positive association between higher neighborhood density and the value of single-family residential properties.

Researchers modeled the values of single-family homes, multifamily rental buildings, commercial spaces and offices in King County, Wash., which includes Seattle. They used property values as a measure of economic value, analyzing them in relation to neighborhood characteristics that correlate with walking, including access to open space and public transportation, mixed-use zoning and pedestrian infrastructure such as sidewalks.

They learned that pedestrian aids, such as sidewalks and shorter street blocks, as well as a mix of retail, commercial and residential properties significantly contributed to increases in multifamily rental property values.

The researchers found that not only did the value of single-family residential properties increase with density of surrounding development, but that the quality of neighborhoods, as defined by access to other land uses, including parks, increased with density as well. But one of the lead researchers suggested some caution: "We should be careful to put the research results in the context of King County, where high residential densities are not those of Manhattan, and a relatively small proportion of the housing stock is in high-rise development," said Anne Vernez Moudon, a UW professor of urban design and planning who was one of the lead researchers.

"The results should not come as a complete surprise," Moudon said, "as it is well known that property values in neighborhoods like Queen Anne, packed with dense, single-family development and intermittent low-rise apartment buildings and condos near retail, are substantially higher than in some of the county's sprawling subdivisions."

It was more surprising, Moudon said, "to find that proximity to retail has a positive effect on multifamily rental properties, and that the value of retail properties benefited from strong pedestrian infrastructure."

"The Economic Value of Walkable Neighborhoods" was published in the April issue of Urban Design International. Dong Wook Sohn of Hongik University in Seoul, South Korea, started the research as part of his UW doctoral dissertation. Jeasun Lee, a UW graduate now at Yonsei University in Seoul, is a third author of the paper.
